The growing popularity of websites such as Facebook, Twitter and LinkedIn, has prompted the NLRB to receive an increasing number of charges related to social media sites this year. On September 2nd, Administrative Law Judge, Arthur Amchan, found the discharge of five employees from a Buffalo, New York nonprofit organization unlawful based on comments the employees posted to Facebook which concerned working conditions and included workload and staffing issues. This is the first case involving Facebook to have resulted in an ALJ decision following a hearing.
